Acceptance of Terms

EnSpire, is provided by BenQ Corporation and our affiliates (“BenQ”, “we”, “us”, “our”). By registering with and using EnSpire in any way, you agree to comply with these Terms of Service, Privacy Policy, and any other legal notices or conditions or guidelines posted on BenQ.com.

If you are entering into these Terms of Service on behalf of a company or other legal entity, you represent that you have the authority to bind such entity, its affiliates, and all users who access EnSpire through your account to these Terms of Service. You further agree that you assume all responsibility and liability in connection with your use of EnSpire whether in your personal capacity or on behalf of such a company or other legal entity, and you shall be solely responsible for all disputes, if any, that arise due to your use of EnSpire.

BenQ may, in our sole discretion, suspend or refuse to offer EnSpire to any person or entity at any time in case of dispute, breach of these Terms of Service or alleged violation of any applicable law.

User under Age 13*

EnSpire is available only for individuals aged 13 years or older. If you are age 13 or older but under the age of 18, or the legal age of majority where you reside if that jurisdiction has an older age of majority, then you agree to have your parent or guardian review and accept these Terms of Service on your behalf. If you are a parent or guardian agreeing to these Terms of Service for the benefit of a child over the age of 13, then you agree to and accept full responsibility for that child’s use of EnSpire, including all financial charges and legal liability that he or she may incur.

Your Responsibilities

  • Relationship. BenQ is a “service provider” to you, and you are a “customer” of BenQ. BenQ is not responsible for any relationship or activity between you and any natural persons accessing or using your EnSpire account, the websites, pages, features, or content created by you.
  • User Content. You must not use EnSpire to submit, post, or transmit any content that creates or may create a risk of harm, loss, damage, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person, to any animal or to any property; contains or may contain any information or content that is not correct and current, is illegal (including, without limitation, disclosing insider information under securities law or of another party’s trade secrets, soliciting for personally identifiable details), harmful, abusive, racially or ethnically offensive, defamatory, infringing, harassing, humiliating to other people (publicly or otherwise), libelous, or threatening, constitutes or may contribute to a crime or tort, or shows inappropriate content which is adult in nature, such as any nudity in a sexual context, exposed genitalia, or any content with adult themes.
  • Data Protection. You acknowledge and agree that you are solely responsible for complying with all applicable data protection laws and regulations (including those applying to personal information) in connection with your access and use of EnSpire. You shall not by yourself, cause or permit any other party to impersonate another person or otherwise misrepresent your affiliation with a person or entity, conduct fraud, hide, or attempt to hide your identity, or disclose any information that you do not have the consent to disclose (such as confidential information of others, including their personally identifiable information).
  • Security and Connection Network. You are solely responsible for meeting the technical requirements of EnSpire, and maintaining the security measures against any viruses, interruption, or loss of data relating to the display, manipulation, processing, storage, transmission, or use of any content, and internet connections that materially or adversely affects the use, functionality, or performance of and your experience with EnSpire. BenQ is not liable for your connection networks or devices used in connection with EnSpire and we encourage you to back up your data regularly and frequently.
  • Third Party Rights. You agree that any content that you submit or transmit through EnSpire does not and will not violate any law, or infringe any rights of any third party, including without limitation any Intellectual Property Rights, publicity rights, or rights of privacy. This includes that you must, at your own cost and responsibility, obtain the license or permission for using any third-party work or intellectual property, including but not limited to photography, portrait, music, font style, template, and design pattern, trademark, trade dress and service mark, and any patent, copyright rights, moral rights, rights of publicity, goodwill, trade secret rights and other intellectual property rights therein or thereto.

    • Indemnity

  • You agree to defend, indemnify and hold BenQ‚ and its affiliates, and their respective officers, directors, employees, agents and licensors harmless from all judgments, awards, losses, liabilities, costs and expenses, including but not limited to reasonable attorney's fees, expert witness fees, and costs of litigation arising out of or based on (a) your use of EnSpire, including the content you submit, post to or transmit through EnSpire, (b) your violation of the Terms of Service and/or (c) your violation of any Intellectual Property Rights or other rights of a third party.

    • International Use*

  • EnSpire is controlled and operated in Taiwan. Although EnSpire may be accessible worldwide, we make no representation that EnSpire or the materials on EnSpire are appropriate or available for use in locations outside Taiwan, and accessing EnSpire from territories where its use is illegal is prohibited. Those who access or use EnSpire from other jurisdictions do so at their own volition and are entirely responsible for compliance with all applicable Taiwan and local laws and regulations, including but not limited to export and import regulations.

  • ALL ENSPIRE PRODUCTS, FEATURES, SERVICES AND/OR LICENSE PROVIDED ON AN “AS IS”, “AS AVAILABLE” AND “WITH ALL FAULTS” BASIS WITHOUT ALL WARRANTIES, EXPRESS OR IMPLIED OF ANY KIND, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OR THOSE ARISING BY LAW, STATUTE, USAGE OF TRADE, COURSE OF DEALING. BENQ SHALL NOT HAVE ANY LIABILITY TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, LOSS OF REVENUE OR PROFIT, LOST OR DAMAGED DATA OR OTHER COMMERCIAL OR ECONOMIC LOSS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR THEY ARE FORESEEABLE. YOU AGREE THAT YOUR USE OF ENSPIRE SHALL BE AT YOUR SOLE RISK.

    • Miscellaneous

  • The Terms of Service represent the entire agreement between you and us with respect to the subject matter addressed herein and supersedes all prior to contemporaneous agreements or understandings, written or oral. The Terms of Service shall be binding upon and inure to the benefit of the parties hereto and their respective successors and lawful assigns.
  • If you use any part of EnSpire in combination with or along with a third-party device or service, you should review their terms of service because you might need to agree to additional or different terms.
  • The Terms of Service will be governed by and construed in accordance with the laws of Taiwan, without regard to its conflicts of law provisions. In case of any dispute or lawsuit, you agree to the personal jurisdiction by and venue in Taiwan Taipei District Court, and waive any objection to such jurisdiction or venue.

    • BenQ may, in its sole discretion, modify or revise these Terms of Use at any time without notice to you. You agree to and will abide by such modifications or revisions by your continual usage of EnSpire.
